Former mayor of Coari, in AM’ countryside, Adail Pinheiro will have to return R$ 360 thousand to FNDE for irregularities

MANAUS – The former mayor of Coari (363 kilometers from Manaus), Manoel Adail Amaral Pinheiro, was sentenced by the Court of Audit (TCU) to return R$ 164,793, adjusted for inflation and interest, the coffers of the National Fund for Education Development (FNDE), for irregularities in the application of resources passed through the National Program of School Transport (Pnate), between 2006 and 2008. That is: more than 14 years ago. Calculated based on the Broad Consumer Price Index (IPCA), which measures inflation in the country, the amount rises to at least R$ 360,799.

The TCU also applied a fine of R$ 29,000 to the former mayor, based on the Internal Rules of the Court of Accounts, in addition to considering the accounts established at the request of the FNDE to be irregular. He has 15 days from the notification to prove the deposit of the amount in the accounts of the Fund, and may install the debt in up to 36 times.

The ruling No. 2022/2022, derived from a decision of the 1st Chamber of the TCU, was published on the last 25th. Process TC 017.303/2018-4, which generated the Special Audit, was reported by substitute minister Weder de Oliveira. The amount analyzed referred to four installments passed on by FNDE, two of them in 2006 and two in 2008. The amounts ranged between R$ 9.34 thousand and R$ 75 thousand.

According to the TCU, failure to provide proof of payment of any installment will result in the early maturity of the outstanding balance, and the judicial collection of debts is authorized if the notifications are not met. The Court forwarded a copy of the decision to the Amazonas State Prosecutor’s Office and the FNDE.

Adail Pinheiro was in power for the last time in 2012, when he was elected to return to Coari City Hall. Shortly thereafter, he was removed from office and, in 2014, had his candidacy registration revoked by the Superior Electoral Court (TSE), during which time he was imprisoned in Manaus, suspected of integrating a network of sexual exploitation of children and adolescents in Amazonas.

Cassation

The cassation occurred after an appeal from the Electoral Public Ministry (MPE), based on the Ficha Limpa Law. But, since then, Pinheiro has been condemned successively by the TCU, for several irregularities in accounts rendering, including in the Education area.

In 2021, Pinheiro and his successor, Igson Monteiro da Silva, were sentenced by the TCU to return R$ 603,000 to the National Treasury, on the grounds of “failure to prove the proper and regular application” of funds, transferred seven years ago by the Ministry of Social Development and Fight against Hunger, through the programs of Basic Social Protection (PSB) and Special Social Protection (PSE).

In February this year, Pinheiro was notified by the State Audit Court (TCE) to return R$ 77 million to the public coffers of Coari, with a deadline of 30 days to prove the deposit. The former mayor was not located to comment on the decision.
