President of Aleam enters ADI to ensure competitiveness of the ZFM and strengthens fight against federal decree

MANAUS – The fight against the federal government’s decrees that penalize products manufactured in the Manaus Free Trade Zone (MFTZ) has gained another ally. The Legislative Assembly of Amazonas (Aleam) filed on Thursday, 5, through the Attorney General of the Legislature, a Direct Action of Unconstitutionality (ADI) in the Supreme Court (STF).

The ADI number 7160/2022 was signed by the members that make up the board of Aleam and adds to three other actions brought by the Government of Amazonas, the Solidarity party and the Bar Association of Brazil (OAB). With the edition of decree 11.055/2022, the rate of the Tax on Industrialized Products (IPI) was changed for the sector of concentrates, without ensuring the exceptionality of the products of the MFTz.

In Brasilia, the state lawmaker president of Aleam said that the decision to be in the capital of the country is a way to try to sensitize the ministers of the STF. “Since the beginning I have defended dialogue, conciliation in speeches and actions. However, we are in a moment in which the legal remedy is necessary, under penalty of having thousands of jobs jeopardized in our state. We have excellent technicians at Aleam, who scrutinized the decrees so that we could contribute in the best possible way to maintaining the competitiveness of our economic matrix”, he said.

After meeting with Minister Alexandre de Moraes, lawmaker and Governor Wilson Lima (UB) had an audience with the president of the STF, Luiz Fux, to discuss the points of the decree that harm the competitive advantages of the Manaus Free Trade Zone, which attract companies to the Manaus Industrial Pole, and seek measures that make it impossible for the decree to remain in place.

“Minister Alexandre de Moraes was attentive to the arguments presented, he understands the importance of the FTZ and today we will be with President Fux. We are using the legal and political remedies to try to prevent the loss of competitiveness of the MFTz and, consequently, the damage to the model that generates more than 100,000 jobs in our state. Our expectations are the best, we rely on the sensitivity of the ministers, “said the chairman of the Legislative House.

New action in the Supreme Court

The new ADI of the Government of Amazonas against the latest decision of the federal government was filed on Wednesday, 4. “We are filing this ADI because we spent the last days preparing a consistent piece to be able to have the largest possible amount of technical arguments to sensitize the minister, Alexandre de Moraes. We are asking for the injunction so that this decree does not come into force and leave, initially, out the products of the MFTz, “concluded the governor Wilson Lima.
