MANAUS – The public constest of the Secretary of Public Safety of the Amazon (SSP-AM) was suspended after the decision of the auditor of the Court Auditors of Amazonas (TCE-AM), Mario Filho, granted in the afternoon of Tuesday, 17, by injunction requested by the External Control Department of the Court of Amazon (Secex).

The contest, which provided for 150 vacancies in positions of senior level technician and operational assistant, was denounced through the Court Ombudsman for “irregularity regarding the requirement of psychotechnical / psychological examination for positions in the contest. Sought by the CENARIUM reporting team, the SSP has not commented until the publication of this story.

According to Secex, this requirement, without legal justification, contradicts the rules of application of the competition laid down in the Binding Precedent 44 of the Supreme Court (STF). According to the precedent, only “the law can subject a candidate for public office to a psychotechnical examination”. Secex’s request is to change the law on the positions or to remove this phase of the public competition.

In granting the request for a precautionary measure, auditor Mário Filho emphasized the evidence that may lead to the practice of illegal and illegitimate acts. In addition, according to the auditor, if the Court of Auditors does not take urgent measures for the regularization, which, if not accomplished, can put the public contest at risk, it can, in turn, lead to irreversible damage to the public coffers.

According to the decision published in the Electronic Official Journal of the TCE-AM, the suspension of the contest should happen immediately. “I consider it appropriate that is granted time to those responsible for the SSP-AM to submit a defense and documents about the aspects raised in the representation of this order. Such a precautionary measure should be maintained until justifications are presented in relation to what was pointed out by Secex and that the Court of Accounts can analyze the facts presented in representation, “pointed out the auditor of the TCE-AM, Mario Filho.

Recommendation

The Amazonas Public Ministry (MP-AM), through the 61st Prosecutor’s Office of External Control of Police Activity (Proceap), issued a recommendation to the State Government, seeking the maintenance of the rules contained in the calls for tender of the Civil Police of Amazonas (No. 01 and 02/2021/PCAM). The recommendation was published in the Electronic Official Gazette of MP-AM, the last day 13, after Wilson Lima announced the expansion of the amount of discursive tests to be corrected, which would expand, also, the reserve register of approved candidates.

“It is up to the Public Ministry, especially Proceap, to ensure the defense of rights, guarantees and principles provided in the Constitution, helping to strengthen the feeling that we must obey, above all, the rule of law. We will remain vigilant on all stages of ongoing competitions, always with the aim of improving police activity and meet the expectations for security of the Amazonian society,” said the Prosecutor João Gaspar. 

The recommendation deals specifically with the barrier clause of the first phase of competitions for the positions of Civil Police delegate, Civil Police Investigator and Civil Police Clerk, and aims to maintain the original forecast of the number of discursive tests to be corrected.

The measures taken in relation to this recommendation should be communicated to the Amazonas State Prosecutor’s Office within 30 days.
